SECURITY OF PAYMENTS

Pursuant to Legislative Decree 206/2005 (Consumer Code), you have the right to withdraw from the contract without penalty and without specifying the reason within 14 working days from the day you receive the products. To exercise the right of withdrawal, you must notify us of your decision by an unequivocal statement, for example by e-mail or postal mail, within the expiry of the withdrawal period.

Subsequently you will have to return the products intact, in the original packaging, within 14 days of communicating your wish to withdraw, to the following address: Erboristeria L'albero della vita - Via Milite Ignoto 12 - 21027 Ispra.

The return of the products is at your expense and under your responsibility. Do not return products COD, as they will not be accepted.

As soon as we have received the products, we will refund the sums paid to us, including delivery costs (with the exception of the additional costs deriving from your possible choice of a type of delivery other than the least expensive type offered by us) within 14 days, with the same means of payment used by you, unless otherwise agreed, and at no cost to you.

If the ordered products are not collected and returned to the sender, you will still be required to pay the shipping costs incurred by us for returning the package.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal referred to in articles 52 to 58 for distance contracts and contracts negotiated away from business premises is excluded in relation to:

1. a) service contracts after the complete provision of the service if the execution has begun with the express agreement of the consumer and with the acceptance of the loss of the right of withdrawal following the full execution of the contract by the professional;
2. b) the supply of goods or services whose price is linked to fluctuations in the financial market which the professional is unable to control and which may occur during the withdrawal period;
3. c) the supply of made-to-measure or clearly personalized goods;
4. d) the supply of goods liable to deteriorate or expire rapidly;
5. e) the supply of sealed goods which do not lend themselves to being returned for hygienic or health protection reasons and which have been opened after delivery;
6. f) the supply of goods which, after delivery, are, by their nature, inseparably mixed with other goods;
7. g) the supply of alcoholic beverages, the price of which has been agreed at the time of conclusion of the sales contract, the delivery of which can only take place after thirty days and the actual value of which depends on market fluctuations which cannot be controlled by the trader;
8. h) contracts in which the consumer has specifically requested a visit from the professional for the purpose of carrying out urgent repair or maintenance work. If, on the occasion of this visit, the trader provides services in addition to those specifically requested by the consumer or goods other than the spare parts necessary to carry out maintenance or repairs, the right of withdrawal applies to these additional services or goods;
9. i) the supply of sealed audio or video recordings or sealed computer software which have been unsealed after delivery;
10. l) the supply of newspapers, periodicals and magazines with the exception of subscription contracts for the supply of such publications;
11. m) contracts concluded at a public auction;
12. n) the provision of accommodation for non-residential purposes, the transport of goods, car rental services, catering services or services relating to leisure activities if the contract provides for a specific date or period of execution;
13. o) the supply of digital content through a non-material support if the execution has begun with the express agreement of the consumer and with his acceptance of the fact that in this case he would have lost the right of withdrawal.

In compliance with article 59, items c, d, e and f, we avail ourselves of the right to withdraw from returns on the following products: Perishable or custom-made products (such as herbal teas and loose herbs, food supplements, eco-bio cosmetics , essential oils, Acqua di Ispra and Perle di Ispra), unopened or partially used products.

You will be responsible for any diminished value of the products resulting from handling other than what is necessary to establish the nature, characteristics and functioning.
